Planned Community Declaration
Violation Standard Operating Procedure (SOP)
As of February 4, 2015
The Meadowbrook Farms Homeowners Association (HOA) Executive Board believes that all homeowners and renters should be familiar with and should comply with the Planned Community Declaration.
The Meadowbrook Farms HOA does not employ a management agency to enforce the Planned Community Declaration regarding violations and noncompliance. Instead, the HOA relies on homeowners who volunteer as candidates for the position of director on the Executive Board.
In an effort to codify the current procedure employed by the Executive Board regarding violations and noncompliance, the Meadowbrook Farms HOA will follow the procedure listed below to positively and amicably resolve homeowner violations of the Planned Community Declaration.
1. On-the-spot corrections. In the event an Executive Board member observes a violation and is able to immediately (same day) contact the homeowner or renter (as applicable), the Executive Board member will speak to the homeowner or renter (as applicable) in an effort to positively and amicably resolve the situation.
Taking immediate and positive action displays that we have proactive homeowners who care about the subdivision and property values, and the action informs other homeowners that the HOA remains actively enforced. Most importantly, the Executive Board greatly appreciates homeowners who take immediate action to comply with the Planned Community Declaration. Positive resolution does not require further action.
2. Observation of a violation. In the event an Executive Board member observes a violation and is unable to speak to the homeowner or renter (as applicable) or a homeowner observes a violation and files a complaint, the Executive Board will send the homeowner a friendly reminder via email or postal letter to correct the violation. The letter will inform the homeowner of the violation and afford the homeowner 14 days to comply with the Planned Community Declaration. The Executive Board will make note of the date of the violation.
3. Homeowner fails to respond to the contact from the Executive Board. If the homeowner fails to respond positively to the friendly reminder via email or letter, the Executive Board will then send a Notification Letter of Violation. The Executive Board will afford the homeowner 14 days to comply with the Planned Community Declaration or face possible legal action.
4. Homeowner fails to take any action to correct the violation. The Executive Board will seek legal counsel to discuss a legal plan of action.
This SOP affords a homeowner two 14-day time periods to correct the violation and comply with the Planned Community Declaration before the Executive Board considers pursuing legal action.
Complying with the Planned Community Declaration for Meadowbrook Farms--and enforcing it when necessary--ensures the safety and security of our families, protects homeowner property values, and makes our subdivision desirable in which to live.

1. For the purposes of this SOP and to clarify the terms “quarter” and “quarterly” as used in the Planned Community Declaration regarding violations, the Executive Board will use the following: January-March; April-June; July-September; and October-December.
